Feds May File Suit Against States: Backdoor Union Card Check

Back in August of 2009,  I wrote my opposition to the proposed legislation called “The Employee Free Choice Act,” legislation which would remove secret ballot from union organizing.  This legislation introduced in early March 2009 by Democrats high on their election wins and was an effort to payback union organizers who helped them gain control of Congress and the White House.  The card check legislation never made it out of the House committee and is sitting where all horrendous  freedom limiting proposed legislation should be, in the trash heap.

What is becoming common to the Obama administration are attempts to institute law through the Executive branch by having departments and agencies write new rules, in essence creating laws which have never passed Congress. Heck what do we need Congress for anyway?   This administration appears to believe they alone know what is right direction for the country and if Congress cannot or won’t do their bidding KING Obama will make it so…

The federal government is looking to head off efforts at the state level to block proposed national “card check” legislation.

On Friday, the National Labor Relations Board (NLRB) threatened to sue Arizona, South Carolina, South Dakota and Utah after the states adopted constitutional amendments guaranteeing workers the right to a secret ballot union elections.

According to the Associated Press, the NLRB is arguing that
the state amendments conflict with federal law which gives employers the option of recognizing a union if a majority of workers sign cards to support unionizing.

This move by the NLRB is not about keeping options for employers but rather in hopes that legislation will somewhere in the future pass which makes union coercion easier by removing any opportunity for a secret ballot vote.

These 4 states voted to enact a Constitutional amendment which would ensure the right to secret ballot.  The people of South Dakota, South Carolina, Utah and Arizona stated through the ballot box, they believe in the right to secret ballot.  But the administration cannot allow the peasants speaking with such clarity through their right as sovereign states.

I’m sure given that Utah is SEIU country the union honchos are beside themselves, their demagogue, the anointed O owes them.  How dare they attempt to claim rights through their Constitution?

And Arizona, well can they become anymore irritating to the O administration?  You go Arizona and I hope other states find the ovaries to take a stand in the over reach of the Feds.

This is far from over, there will be more state law suits against the Federal government.  We already have half of the states involved in lawsuits against the Feds with ObamaCare.  Have there ever been a time when so many states have sued the Federal government over Constitutional issues?

The O administration will increase their use of law making through Executive branch initiatives over the next two years.  States through the vigilance of their citizenry  will have to file an ever increasing number of law suits against the Feds.  If this is what it takes to get our Constitutional government back, so be it.
